The historical essay of creation and development of patent service TPU is given. The main activities of patent service, a problem of the organization of inventive work, patent licensed activity and study of research, interuniversity work are analyzed. Questions of use of inventions of TPU in industrial production, scientific and technical developments and educational process are considered. Results of participation of TPU and Interuniversity patent department in competitions and review competitions in inventive and patent and license work are shown

Short historical essay

The beginning of creation of patent service TPU belongs to 1965 when the patent engineer's position was entered into staff of scientific management. The enthusiast of inventive creativity mechanical engineer V.V. Andryushin is appointed to this position. At the same time at local committee of the university (at that time institute) society of inventors and rationalizers (VOIR) will be organized. Same year three employees - V.V. Andryushin and graduate students V.M. Zykov and V.A. Suvorin go for training to Moscow on the High state courses of patent science. Having ended courses, these employees will organize in 1966 at Council of VOIR public patent office which carries out big educational and methodical work among inventors and scientific and pedagogical workers of TPU.

In 1967 as a part of NIS of scientific management the regular patent group which in 1969 will be transformed to patent department with staff of 5 people is created. Because V.V. Andryushin goes to the GDR for passing of a postgraduate study in the field of patent law, the department was headed by Candidate of Technical Sciences V.A. Suvorin. In 1968-1969 in all scientific research institutes at TPU positions of regular patent engineers are entered. Later in them patent groups, and in 1973-1975 - patent and information departments numbering 4-6 staff will be organized.

At the end of 1971 Minvuz of RSFSR issues the order according to which in TPU the Interuniversity patent department which is assigned with the organization in higher education institutions of Western Siberia of patent services and the methodical management by them is created. Creation of Interuniversity patent department is assigned to Candidate of Technical Sciences V.M. Zykov who graduated by this time the Central institute of patent science (CIPK) at the Goskomizobreteny USSR. As the head of patent service TPU V.M. Zykov worked till 1996 then he passed to a position of the senior research associate. Now the head of department of the intellectual and industrial property of TPU is the patent agent of the Russian Federation Z.A. Sovetchen-co. In department O.N. Baturina, V.M. Zykov and N.I. Pospelova work.

In 1973 at scientific and methodical Council of higher education institutions of the West Siberian region the Commission of experts on inventive and patent and license work which chairman appoints V.M. Zykov will be organized. This commission and Interuniversity patent department did further considerable work on the organization and establishing effective work of patent services in higher education institutions of Western Siberia.

Due to the sharp increase in state budget financing, volumes of economic contractual researches and activization of inventive activity the number patent service TPU, including Interuniversity patent department and patent and information departments of scientific research institute, quickly grows. By 1980 the patent service becomes the largest in the Minvuza system of RSFSR, totaling about 30 staff members. Besides, at all faculties, at many departments and in laboratories, positions of patent engineers on a voluntary basis are entered. Thus in TPU the powerful patent and information structure capable to solve complex problems in the field of the organization of inventive and patent and license business is created.

Was one of organizers and the head of Interuniversity patent department, Commission of experts on inventive work of the West Siberian regional scientific and methodical Council and Tomsk public institute of patent science of CS VOIR. Took active part in creation and the organization of work of patent services of higher education institutions of Western Siberia. Was a part of Technical Council of HNO Minvuza of RSFSR and Central Office of VOIR Russian Federation. For honest work and big public work it is awarded two medals of the USSR and numerous breastplates, diplomas and certificates of honor, was a Drummer of 9, 10 and 11 five-years periods. Has about 60 copyright certificates of the USSR and patents of the Russian Federation for inventions and useful models

In 1989-1991 the volumes of economic contractual researches in TPU landslide failed, also state budget financing of research and SURROUNDING was sharply reduced. Together with it also the original patent and information structure created for quarter of the century collapsed suddenly. The patent and information departments of research institutes headed by highly skilled patent engineers (A.M. Adam in Scientific Research Institute VN, L.V. Butenko in Scientific Research Institute EI and N.K. Shumikhina in Scientific Research Institute YaF), were disbanded. The number of Interuniversity patent department was reduced to 4 people, and patent service TPU totals all the 8th persons. The inventive and patent and license work at the university was almost completely winded down. Besides still, as a matter of fact, activity of VOIR and public patent engineers stops.

In 1993. The interuniversity patent department is renamed into department of the intellectual and industrial property. In the mid-nineties indicators of inventive work are in TPU at extremely low level then inventive activity is considerably stirred up, and at the beginning of the 21st century its efficiency sharply increases. Now TPU on indicators of inventive and patent and license work is among the leading higher education institutions of the country. However, for this purpose it was necessary to reconsider strategy and tactics of the organization of patent work, having adapted them for modern economic conditions.

Activity of patent service always was under close attention of the management of the university, namely rectors A.A. Vorobyov, I.I. Kalyatsky, I.P. Chuchalin and Yu.P. Pokholko-va and vice rectors for scientific work V.A. Moskalyov, Yu.P. Pokholkov, V.Ya. Ushakov and V.A. Vlasov. Employees of Interuniversity patent department O.N. Baturina, V.A. Bogatyrev, G.N. Bogin-skaya, T.I. Bychkova, L.L. contributed significantly to development of invention in TPU. Young people, L.F. Kirillov, A.G. Korobko, T.K. Pushnikov, Z.A. of Sovetchen-co, G.G. Fomin and others.

Main activities of patent service

Developing the skills of employees patent

services and scientific pedagogogicheskikh workers

Due to the integration of patent service and activization of inventive work sharply there was a question of preparation of patent shots and increase in patent culture of scientific and pedagogical workers.

According to the solution of CS VOIR in Tomsk at TPU in 1971 the public institute of patent science (TOIP) according to the 2-year program of training is based. V.M. Zykov who worked in this position before the termination in 1985 of the centralized financing of institute is on a voluntary basis appointed the rector of institute. In 15 years the institute trained over one thousand patent engineers social activists, including for TPU - about 150. To training in TOIP there passed all regular and public patent engineers of TPU and scientific research institute and also activists of VOIR and invention. Graduates of TOIP staffed all patent services of higher education institutions, scientific research institute and CB of Tomsk and also BREEZES of the industrial enterprises of Tomsk, Seversk, Strezhevy, Kolpashev and Asin. TOIP and employees of TPU branches ended.

The new legislation in the field of invention of 1973 oriented patent services on significant increase in quality indicators of inventive and patent and license work. To solve successfully this problem, TPU started systematic training of patent engineers of the top skills. For this purpose, since 1973, annually 2-3 patent engineers went for training in CIPK where gained diplomas of an all-union sample. In 15 years all regular patent engineers having the higher education graduated from this institute. Subsequently four of them - O.N. Baturina, L.V. Butenko, Z.A. of Sovetchen-co and N.K. Shumikhina became patent agents of the Russian Federation, and N.E. Yavorovskaya defended the dissertation for a degree of Candidate of Law Sciences.

For the purpose of instilling of patent culture and patent knowledge and also for rendering to employees and students of the methodical help at identification and registration of inventions, the Interuniversity patent department prepared and published a number of educational and methodical developments. Among them it should be noted the manual & #34; Fundamentals of patent science and patent and technical информации" methodical instruction & #34; The Order of carrying out patent and information researches at degree and course проектировании" and other materials and also methodical recommendations about the main directions of inventive activity. Besides, at departments and in laboratories, methodical seminars and discussions were systematically led. Subsequently this work was continued by department of the intellectual and industrial property, paying special attention to legal protection and commercial selling of scientific and technical products of the university.

Completing of patent and literary fund

It is well-known that planned and effective inventive and patent licensed activity is impossible without information on the made domestic and foreign inventions and other intellectual property items and also in the absence of standard, methodical and reference books. For this reason the patent service since 1971 completes fund of descriptions to copyright certificates and patents of the USSR and abstract information on domestic and foreign inventions, industrial samples and trademarks. At the same time the extensive help and search device to patent fund in the form of various indexes and tables is formed. Now the TPU patent fund contains about 1.5 mln units. information on objects of industrial property and copyright of the USSR, Russian Federation and advanced industrial countries of the world. It allowed to refuse in 1976 services of the Tomsk and Kemerovo Center of scientific and technical information at assessment of novelty and technological level of the executed researches and the made inventions.

Any scientific organization of Tomsk has no such fund.

Organization of inventive work

Identification and legal protection of inventions and other objects of patent law always were and remain the major directions in activity of patent service TPU. Increase in volumes of research in scientific research institute and NIS, increase in number of patent service and increase in professional standard of patent engineers, wide use of patent fund for assessment of novelty and technological level of scientific developments, and similarly and a number of other factors, promoted removal of inventive and patent and license work not only on higher quantitative, but also qualitatively new level. So, if in the late sixties - the beginning of the 70th of TPU received 20-30 certificates on inventions, then at the beginning of the 80th their quantity increased up to 300-320. At the same time about 20 inventions which could become subjects to patenting abroad were revealed. Annually 10-15 and more inventions were declared together with the production organizations that promoted their fast industrial use. The highest achievement in the field of the organization of intellectual activity of TPU should be considered obtaining three diplomas on opening: No. 363 (1989), No. 107 (1999) and No. 173 (2001). Not less important achievement was significant improvement of quality of the made-out inventions which indicator - percent of issue of positive decisions on requests for inventions. If in the late sixties - the beginning of the 70th years this rate was 20...25%, then at the beginning of the 80th of-60...70%. And this despite the fact that in the 80th the issue of positive decisions in the USSR was equal to 40%, and in Minvuz of RSFSR - 50...55%. Now this indicator reaches 98...99%.

At the beginning of the 90th the inventive activity at the university was almost completely paralyzed, however since the middle of the same decade it considerably becomes more active, and then its efficiency sharply increases. So, if in 1993-1996 TPU received in a year 4-6 patents, and in 1997-1999 - 40-50, in 2000-2003 80-110, then in 2004 - more than 130. In recent years 6 certificates on trademarks and service marks are received (earlier this type of industrial property was not patented in general).

Organization of patent licensed activity

The analysis of the made inventions showed that scientific and technical developments in the field of creation of polymeric photosensitive materials (HTF, the project head professor V.P. Lopatin-sky) and small-sized betatrons (Scientific Research Institute IN, the head professor V.L. Chakhlov) and some other developments significantly exceed world level. In this regard at the beginning of the 70th the university started foreign patenting of the inventions. Until the end of the 70th of TPU took out 39 patents in the advanced industrial countries (the USA,

Great Britain, Japan, France, etc.) and also in some countries Comecon (ChSSR, the Party of Russian Taxpayers, NRB). Many foreign firms were interested in acquisition of licenses for use of inventions by these patents, however TPU could not realize abroad any license. The reason - lack of industrial technology of receiving photosensitive materials and production of small-sized betatrons. Having found out that there are only experimental samples of these products, foreign firms lost interest in further cooperation with TPU. However commercial realization of small-sized betatrons nevertheless took place - to Great Britain, France, China and some other countries trial samples and the completing knots to them were sold. The sum of each of transactions was from 10 to 40 thousand dollars of the USA.

In the last 5 years the university strengthened the work in the direction of commercial selling of scientific and technical products in which the Innovative and technological center created in 2002 as a part of scientific management is engaged now. 2 licenses are so far sold, 8 more patent and license subjects are in a stage of study and the conclusion of license agreements. For the purpose of further development of licensed activity the specified center will organize now a number of third-party small enterprises which in the work will use the intellectual and industrial property of TPU on a paid basis.

In 2001 works on protection of intellectual property of TPU abroad are begun. In the specified direction in the countries of the European Patent Office and Eurasian Union and also in the USA, South Korea, India and Ukraine the invention & #34 is patented; The Way of pressing of products from powder materials and a press form for it осуществления". The patent of the Eurasian patent department and the decision on issue of the patent of the USA are so far received.

Organization of patent study of research

In process of accumulation of information on domestic and foreign inventions, in the mid-seventies were begun systematic patent and information researches on economic contractual and state budgetary researches of applied character. These researches consisted in assessment of novelty and technological level of the carried-out researches and were conducted at all stages of their performance, since research planning. The specified action allowed to estimate objectively world novelty, to increase technological level and to choose an optimal variant of performance of research and also to reveal a significant amount of new technical solutions at the level of inventions. Patent and information study of research was carried out at rather high methodical level about what

the corresponding conclusions of supervisory authorities of Minvuz of RSFSR testify. At the very end of the 80th these works were stopped in view of lack of financing and when customers of some researches demanded the high scientific and technical level of their performance are renewed in the mid-nineties. Now patent study of research is one of the main directions in activity of patent service, however at the same time its organization and a technique of carrying out are significantly changed. It is carried out more profoundly, but only on the major subjects, and upon the demand of customers of research and SURROUNDING. Such organization of works is recognized experts as optimum.

Uses of inventions

and improvement suggestions

Large-scale use of inventions of TPU in industrial production, scientific and technical developments and educational process belongs to the beginning of the 80th though patent departments of TPU were engaged in this work and earlier. The new legislation of the USSR in the field of invention aimed 1973 the organizations and their patent services at change of a situation in the sphere of realization of inventions. Incentives for activization of works on introduction of inventions in industrial production were for this purpose created, as allowed to increase effectiveness of this work. So already in the mid-seventies for in production it was introduced a number of inventions with obtaining real economic effect, and economy on one of them exceeded 1 million rubles (authors of this invention M.A. Melnikov, A.I. Gavrilin, etc. received the maximum remuneration of 20 thousand rubles). In the 80th annually in industrial production 25-30 inventions, and in research and educational process - 30-40 were worked. Economic effect of realization of inventions in the industry was 700-900 thousand rubles a year, and in separate years exceeded 1 million rubles

In the same time also large-scale use in research and educational process of improvement suggestions which was caused by Minvuz's decision of RSFSR on legitimacy of recognition in the conditions of higher education institution rationalization proposals so-called & #34 began; мини-изобретений" and & #34; ноу-хау". Up to 1990 in TPU 40-50 technical solutions with limited novelty and low inventive level, and mainly were recognized services industry of scientific and educational and pedagogical process as improvement suggestions.

Organization of interuniversity work

At the end of 1972. The interuniversity patent department directed request for a condition of patent services and inventive work to all higher education institutions of Western Siberia (Tyumen, Omsk, Novosibirsk, Tomsk, Kemerovo, Barnaul and Novokuznetsk). It became clear,

that only three higher education institutions (except TPU) - Novosibirsk electrotechnical, Omsk and Kuzbass polytechnical institutes have regular patent engineers, and inventive work is in absolute majority of higher education institutions at the most initial stage of the organization. In this regard in 1973. The interuniversity patent department together with the created Commission of experts of inventive work of the West Siberian regional scientific and methodical Council holds in Tomsk a seminar meeting of regular and public patent engineers of higher education institutions of the region with the invitation of vice rectors for science. Subsequently such seminars were held annually and the different cities of Western Siberia up to 1990. Workers the Goskomizobreteny USSR and the Central patent department of Minvuz of RSFSR and also the leading patent engineers of the country were invited to them as speakers. The main objective of seminars consisted in exchange of experience of work of patent services for the purpose of activization of inventive work.

In 1976 in all higher education institutions of the region having research volume over 1 million rubles patent departments and groups were created, and in higher education institutions with a capacity of researches less than 0.5 million rubles - established posts of patent engineers are entered. Same year the review competition on inventive work which was carried out annually up to 1990 subsequently was held. Same year, competitions of patent services of higher education institutions in Tomsk, Novosibirsk, Omsk and Barnaul were organized. The Interuniversity patent department and regional councils of VOIR acted as initiators of this competition.

In 1978 Minvuz of RSFSR will organize the first review competition on inventive and patent and license work among higher education institutions of the ministry which were carried out annually until the end of the 80th and in which higher education institutions of Western Siberia took the most active part. They took so active part also in seminars meetings of vice rectors and chiefs of patent services of higher education institutions which were held annually in various cities: Moscow, Leningrad, Rostov-on-Don, Vladivostok, Yaroslavl, etc.

The above-stated and other actions positively affected efficiency of inventive and patent and license work. So, higher education institutions of Western Siberia at the very beginning of the 80th on indicators of inventive work were comparable with higher education institutions of traditionally advanced regions - Northwest, Southern and Ural, and some of them and exceeded these indicators.

Performance by Interuniversity patent department of the Minvuza task of RSFSR of three research works on subjects also belongs to interuniversity work: Development of the system of indicators of assessment of inventive activity вуза" & #34; The Organization of inventive and patent and license work in technical вузе" and & #34; Organization of patent and information researches on research applied характера". On the basis of results of performance of these researches Minvuz of RSFSR developed a number of the methodical recommendations submitted on improvement of inventive and patent and license business.

Results of participation of the Tomsk Polytechnic University and Interuniversity patent department in competitions and review competitions on inventive and patent and license work

Following the results of competitions and review competitions among Minvuz's higher education institutions of RSFSR TPU and its patent service of 8 times were awarded with diplomas and 2 times Certificates of honor with delivery of cash bonuses. Twice TPU was noted by Minvuz's diplomas of the USSR and CS VOIR. Only some higher education institutions Northwest tried to obtain such progress (LGU, LETI, LPI, LIAP and LGI, Southern (RGU, NPI) and Ural (UPI) of regions. The advanced higher education institutions of Minvuz also some higher education institutions of Western Siberia - TGU were among, NSU, NETI, API, OmPI and media.

In competitions among higher education institutions of the West Siberian region and Tomsk TPU and its patent service steadily took prizes, and in various nominations: on the best setting of inventive and patent and license work, activity in the field of realization of inventions, the best invention of year, the best inventor of year, etc.

In 2005. Directorate of Fund & #34; Science and будущее" and European Fund & #34; Fusion Energy" recognized TPU as the winner of a competition & #34; Science and technologies of the 21st century for business development - 2005" in the nomination & #34; For the greatest number of the taken-out patents and свидетельств" also awarded with the diploma of the I degree. It demonstrates that TPU, despite drama events of 1992-1996, occupied leadership in patent work among higher education institutions of a system of the Ministry of Education of the Russian Federation again. It is unlikely this result would be achievable if during the previous period in TPU the powerful patent and information infrastructure which in rather short time allowed to reanimate and strengthen patent work would not be created.
